These Terms of Service, along with Our Privacy Policy, Our Acceptable Use Policy and the other terms and policies referenced herein, is an agreement (the "Agreement") between You ("Customer", "You", or "Your") and Volusion, LLC, a Delaware limited liability company ("Volusion", "We", "Us" or "Our"). This Agreement sets forth the terms and conditions of Your use of the http://volusion.com website and the platform, applications, tools, templates and other products and services provided by or through Us (collectively, the "Services"). You may use the Services to create or publish websites and online stores and provide other ecommerce services. (“Your Sites”).

By using or accessing Our Services, You are agreeing to this Agreement and are agreeing that any previous agreements between You and Us with respect to the Services are superseded by this Agreement. If the person entering into this Agreement is acting on behalf of an entity, all references to "Customer", "You" and "Your" shall refer to such entity shall and such person represents that it has the authority to bind such entity to this Agreement. The Services are available only to Customers who are at least eighteen (18) years of age and recognized as being able to form legally binding contracts under applicable law.

We may change or modify this Agreement at any time at Our discretion. Any such changes or modifications shall be effective immediately upon the earlier of (i) Our email notification to You advising You of such changes or modifications, (ii) Your electronic acceptance of the revised Agreement after such changes or modifications have been made as indicated by the "Last Revised" date at the top of this page or (iii) Your continued use of the Services after We post the amended Agreement to this website.

Account Ownership

The person signing up for the Volusion Service is responsible for the account and is bound by these Terms of Service. If you signup on behalf of your employer, your employer owns the account and is also bound by our Terms of Service.

We automatically create accounts for you to accept payments. You are responsible for activating and deactivating these accounts.

Any domain you purchase through us will automatically renew unless you opt out.

  • You must register for an account (the "Account") to access and use the Services by providing your full legal name, current address, phone number, a valid email address and certain other information indicated as required. You agree to ensure that all such information is current and accurate. You acknowledge that We will use the email address that You provide as the primary method of communication, including for billing matters. We may reject Your application for an Account for any reason, in Our sole discretion.
  • You shall designate a single "Point of Contact", which shall have full authority to enter into agreements and make binding decisions on Your behalf. For security reasons, only the Account owner or Point of Contact designated by the account owner will be allowed to make account changes or cancellations or to designate a new Point of Contact. You agree that We may rely on representations made by Your Point of Contact. You may change Your Point of Contact at any time by giving Us written notice. If there is reasonable doubt about the authenticity of any such instruction, notice, document or communication, We reserve the right to require additional authentication from You.
  • You must keep Your password secure. We encourage You to use best practices in creating, regularly changing and securing Your password. We will not be liable for any loss or damage from Your failure to maintain the security of Your Account or Your password. You agree to immediately notify Us of any unauthorized use of Your password or any similar breach of security.
  • In the event of a dispute regarding Account ownership, We reserve the right to request documentation to determine or confirm Account ownership. Documentation may include a copy of Your business license or charter, government issued photo ID, the last four digits of the credit card on file, etc. We retain the right to determine, in Our sole judgment, rightful Account ownership and transfer an Account to the rightful owner. If We are unable to reasonably determine the rightful owner of an Account, We reserve the right to temporarily disable an account until resolution has been determined between the disputing parties.
